Terms and conditions

These general terms and conditions apply to all offers, quotes, agreements and deliveries of Bikeshop Zeeland B.V. (trade name: Bikeshop Zeeland).

Article 1 — Definitions

• Seller: Bikeshop Zeeland B.V., trading as Bikeshop Burgh-Haamstede, located at Burghseweg 58A, 4328 LB Burgh-Haamstede, registered with the Dutch Chamber of Commerce (KvK) under number 85629626.
• Buyer: the natural person or legal entity entering into an agreement with Seller.
• Consumer: the Buyer who is not acting in the course of a profession or business.
• Product: any bike, accessory, service or combination thereof offered by Seller.
• Premium used: a used bike from the rental fleet of Fietsverhuur Zeeland B.V., with known mileage.
• Ordering new: a brand-new Urban Arrow, purchased to Buyer's order through the official manufacturer.

Article 2 — Applicability

These terms and conditions apply to every offer by Seller and to every agreement concluded between Seller and Buyer. Before the agreement is concluded, Seller makes the text of these terms and conditions available to Buyer. By placing an order or by accepting a quote, Buyer accepts these terms and conditions.

Article 3 — Quotes and offers

All quotes are without obligation and valid for thirty (30) days after being sent, unless stated otherwise. Seller may withdraw a quote as long as Buyer has not accepted it in writing.

Offers or prices on the website may be changed without prior notice. Seller is not bound by quotes or offers that contain obvious mistakes or typing errors.

Article 4 — Agreement

An agreement is concluded as soon as Buyer has accepted Seller's quote in writing (email is sufficient), or as soon as Buyer has paid a deposit.

Seller reserves the right to refuse an order without stating reasons, or to accept it only under different conditions.

Article 5 — Prices

All prices on the website and in quotes are in euros and include VAT, unless expressly stated otherwise. Premium used bikes normally fall under the standard VAT scheme (21%); business buyers entitled to deduct VAT can receive an invoice with VAT itemised on request.

On top of the price of every (electric) bike, the statutory battery disposal fee is charged (currently € 12,50 per bike).

Delivery costs are charged separately and amount to at least € 49,- for delivery in the Netherlands or Belgium. The exact delivery costs are stated in the quote.

Article 6 — Payment

Unless otherwise agreed in writing, the following applies:

• Premium used bikes: full payment before or upon delivery/pick-up.
• New bikes (to order): a deposit of at least 20% when ordering, the balance upon delivery.
• Accessories: payment upon purchase.

Payment is made by bank transfer, in cash or by debit card on pick-up. In the event of non-payment, Seller is entitled to charge the statutory interest and any collection costs.

Article 7 — Delivery and risk

Delivery times are indicative and not strict deadlines. If the delivery period is exceeded, Seller is not in default until Buyer has given Seller written notice of default and granted a reasonable period for performance.

Premium used: delivery usually takes place within approx. 14 days of confirmation, depending on availability from the rental fleet.

New bikes: the delivery time depends on Urban Arrow Nederland and is requested per model when the quote is prepared.

The risk of the goods passes to Buyer at the moment of delivery or, in the case of pick-up, at the moment the bike is received by Buyer or by a third party designated by Buyer.

Article 8 — Handover and acceptance

On delivery or pick-up, Buyer (or a third party designated by Buyer) signs a delivery document recording the condition of the bike at that moment. Any comments on the visible condition must be noted on the delivery document before signing.

If a third party designated by Buyer takes receipt of the bike without reservation, any later claims by Buyer regarding the condition of the bike on delivery lapse.

Article 9 — Warranty

New bikes: New bikes are covered by the factory warranty of the relevant manufacturer (Urban Arrow, Cube). For Urban Arrow this is 2 years on the frame and main components. Bosch eBike components are covered by the Bosch warranty (2 years or 500 charge cycles on the battery). The Seller is an authorised dealer and handles warranty claims with the manufacturer on behalf of the Buyer.

New bikes: these are covered by the Urban Arrow factory warranty, currently 2 years on the bike and 5 years on the frame. The battery is covered by the warranty as provided by Bosch.

The warranty lapses if:

• The bike has been used for purposes other than those for which it is intended;
• Repairs or modifications have been carried out by third parties without prior consent;
• The damage was caused by falls, accidents, misuse or insufficient maintenance;
• There is normal wear and tear (tyres, brake pads, cables, chain/belt);
• The bike has been modified with non-original parts.

Warranty claims are preferably reported by email to info@fietsverhuurzeeland.nl with a description and photos of the defect. Service and warranty handling take place in our workshop at Burghseweg 58A.

Article 10 — Right of withdrawal (consumer)

For distance contracts, Consumer has the right to dissolve the agreement without giving reasons within fourteen (14) days of receiving the bike (right of withdrawal).

To exercise this right, the Consumer sends an unambiguous statement (email is sufficient) to info@fietsverhuurzeeland.nl before the period expires. The Consumer returns the bike in its original condition — undamaged, unused or barely used, with all accessories — within fourteen (14) days of the withdrawal.

The costs of returning are borne by Consumer. If the returned bike has decreased in value as a result of use beyond what was necessary to establish its nature, characteristics and functioning, Seller may charge this decrease in value.

The right of withdrawal does not apply to products manufactured to Consumer's specifications or that are clearly personal in nature (for example a newly ordered bike in a specific colour or with specific options).

Article 11 — Retention of title

All goods delivered by Seller remain the property of Seller until Buyer has fully met all obligations arising therefrom.

Article 12 — Liability

Seller's liability is limited to the amount paid out by Seller's liability insurance in the case in question. If no payment is made, liability is limited to the invoice value of the Product concerned.

Seller is not liable for indirect damage, including — but not limited to — consequential damage, lost profits, missed savings or damage due to business interruption.

The limitations of liability set out in this article do not apply if the damage is the result of intent or gross negligence on the part of Seller or its managerial staff.

Article 13 — Force majeure

Seller is not obliged to fulfil any obligation if prevented from doing so by force majeure, including supply problems at Urban Arrow Nederland, transport disruptions, fire, theft, pandemics or other circumstances beyond Seller's control.

Article 14 — Disputes and applicable law

All agreements between Seller and Buyer are governed exclusively by Dutch law. Disputes are preferably resolved through mutual consultation. If that fails, the court in the district of Zeeland-West-Brabant has exclusive jurisdiction to hear disputes, unless mandatory law provides otherwise.

Consumers may also submit disputes to the competent court of their place of residence.

Article 15 — Amendments

Seller is entitled to amend these general terms and conditions. The most recent version is always available on this page. For agreements already concluded, the terms and conditions as applicable at the time the agreement was concluded remain in force.
